1. Agreement and accounts
These Terms of Service form an agreement between you and [Eternity Centre], ABN 75161676982 ("The Confidence Academy", "we", "us"). By visiting our websites, creating an account, or buying or using any course, resource, workshop, or program (the "Services"), you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Services.
You must be at least 18 to create an account or buy the Services. Children may take part only through a parent, guardian, or school (see section 6).
You are responsible for the accuracy of your account details, for keeping your password confidential, and for all activity under your account. Accounts are personal and must not be shared.
2. Our services and your licence
When you enrol or buy, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Services for your own learning. Unless we say otherwise, access to a course or resource lasts for the period stated at purchase, or for as long as we offer that product.
You may not copy, resell, share, record, or redistribute course materials, login details, or live sessions, or use them to train, build, or operate another product or service.
We may update, improve, or discontinue parts of the Services. Where we withdraw a paid product you are still using, we will give reasonable notice and, where appropriate, a remedy.
3. Payments, refunds and your consumer rights
Prices are in Australian dollars and include GST where applicable, unless stated otherwise. You agree to pay the price shown at checkout. Payment plans, where offered, are described at purchase, and you authorise us and our payment processor to charge each instalment when due.
Refunds. [Insert refund policy, for example: "If you are not satisfied, you may request a refund within [X] days of purchase, provided you have completed less than [X]% of the course."] Refund requests should be sent to the email in section 8.
Australian Consumer Law. Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. Nothing in these terms limits those rights.
4. Intellectual property and your content
All course materials, videos, workbooks, frameworks, names, logos, and website content belong to us or our licensors and are protected by copyright and other laws. Your purchase gives you a licence to use them, not ownership.
If you submit content to us, such as workbook responses, comments, or testimonials, you keep ownership of it. You give us a non-exclusive, royalty-free licence to use it to deliver and improve the Services. We will not publish your name or story in marketing without your written permission.
You confirm that anything you submit is yours to share and does not infringe anyone else's rights.
5. Acceptable use
We want our community to be a respectful, supportive place to build confidence. You agree not to:
harass, bully, threaten, or discriminate against other members, coaches, or staff;
post unlawful, offensive, or misleading content, or spam and unsolicited promotions;
share your account, or copy or distribute paid materials;
interfere with or attempt to breach the security of our websites or platforms;
use the Services to provide a competing product or to collect other people's information.
We may remove content, suspend access, or end accounts that breach these rules.
6. Children, schools and group programs
Children under 18 may use our Services only with the consent and supervision of a parent or guardian, or through a school or organisation that has arranged the program. The parent, guardian, or school is responsible for the child's participation and for these terms.
Schools and organisations that engage us agree to obtain any consents needed from parents and guardians before sharing student information with us. Pricing, delivery, and payment arrangements for school programs are set out in the engagement agreement between us and the school, which prevails over these terms if they conflict.
7. Educational content only
The Confidence Academy provides education, coaching, and personal development content. It is not psychological, medical, or therapeutic treatment, and it is not legal or financial advice. It is not a substitute for care from a qualified professional. If you are struggling with your mental health, please speak with your doctor or a mental health professional, or contact Lifeline on 13 11 14 if you need support now.
We share strategies we believe are helpful, but we cannot guarantee any particular result. Your outcomes depend on your own effort, circumstances, and choices.
8. Liability, termination, governing law and contact
We protect personal information with access controls, secure platforms, and staff training, but no online system is completely secure. Please use a strong, unique password and keep it private.
We keep personal information only as long as we need it for the purposes above or to meet legal obligations (for example, tax records are held for at least five years). When it is no longer needed, we delete or de-identify it.
If a data breach is likely to cause serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
9. Access, correction, complaints and contact
Liability. To the maximum extent the law allows, and subject to your rights under the Australian Consumer Law, we are not liable for indirect or consequential loss, loss of profit, or loss of data arising from your use of the Services. Where liability cannot be excluded, it is limited, at our option, to resupplying the Services or refunding the amount you paid for them.
Termination. You can stop using the Services at any time. We may suspend or end your access if you breach these terms, with notice where practical. Sections that by their nature should continue (intellectual property, liability, governing law) survive termination.
Availability. We aim to keep our websites and platforms running smoothly but cannot promise uninterrupted access, and we are not responsible for outages caused by third-party providers or events outside our control.
Governing law. These terms are governed by the laws of [State/Territory], Australia, and you submit to the non-exclusive jurisdiction of its courts.
Changes. We may update these terms from time to time. The current version is always on our website, and continued use after a change means you accept it.
